The United Nations asks for clarification.. Did Hadi violate international treaties by appointing "Al-Moussai" as attorney general?
English - Thursday 17 March 2022 الساعة 08:09 pmThe United Nations called on the Yemeni government to clarify the eligibility of Ahmed Al-Moussai to occupy the position of Attorney General of the Republic of Yemen.
This came in a letter addressed by the Special Rapporteur on the independence of judges and lawyers at the United Nations to the Yemeni government.
The letter was received by the Permanent Representative of Yemen at the United Nations Mission, Ambassador Ali Mujawar on March 3, who in turn transmitted it to Foreign Minister Dr. Ahmed Mubarak on March 6.
The letter of the United Nations Special Rapporteur on the independence of judges and lawyers listed the reasons that led to the judges' strike in Yemen and the manipulation of appointments in the judiciary, and devoted a large part to the wrong appointment of the Attorney General.
The letter included an appendix explaining the treaties signed by the Yemeni government, which stipulate eligibility for appointment to the judiciary or the position of attorney general.
In the letter, the UN rapporteur called for providing information on “measures taken to address the concerns that led to the strike in the judiciary, providing information on measures taken in Yemen to ensure that appointments to the position of the Public Prosecutor meet legislative requirements, and providing information on measures taken to ensure access to justice in the country in the light of the prolonged strike.
The letter confirmed that the decision of interim President Abd Rabbo Mansour Hadi, to appoint Major General Ahmed Al-Mousay, to the position of Attorney General, did not follow the procedure stipulated in Yemeni legislation in accordance with Judicial Authority Law No. 1 of 1991 and its 2013 amendments.
It explained that this appointment required nomination and prior approval from the Supreme Judicial Council, which is allegedly not the case.
The United Nations Special Rapporteur also expressed his concerns about the compatibility of the decision to appoint Al-Mousay to the position of Attorney General in Yemen with international human rights law.
